Atlas Terms of Use

1. About These Terms

These Terms of Use ("Terms") govern access to and use of Atlas, a Govtech Africa platform for conducting, managing, validating and publishing institutional assessments. Atlas is provided by Govtech Africa Limited ("Govtech Africa", "we", "us" or "our").

Where Atlas requires registration or sign-in, these Terms become binding when you actively accept them through the Terms acceptance control presented by Atlas. If you access Atlas on behalf of a ministry, department, agency, institution, company or other organisation, you confirm that you are authorised to accept and comply with these Terms within the scope of the permissions granted to you. Your cookie choices and acknowledgement of the Privacy & Data Protection Notice are separate from acceptance of these Terms.

2. Relationship with Programme Rules and Client Agreements

Atlas may be deployed for a government institution or other organisation that owns, commissions or administers an assessment programme (the "Programme Controller"). Your use of Atlas may also be subject to programme rules, assessment methodologies, participation conditions, confidentiality obligations and a separate written agreement between Govtech Africa and the Programme Controller.

If these Terms conflict with a specific written agreement governing an Atlas deployment, that written agreement will prevail to the extent of the conflict. Programme-specific rules may impose additional obligations on assessors, validators, panel members, administrators and participating institutions.

3. Eligibility and Authorised Access

Atlas is intended for authorised professional and institutional use. You may use Atlas only if you are legally capable of accepting these Terms and have been authorised to access the relevant programme, assessment, workspace or function.

Access rights are personal to the authorised user and must be used only for legitimate programme purposes.

4. Accounts and Account Security

Where an account is required, you must provide accurate information, keep your authentication credentials confidential and take reasonable steps to prevent unauthorised access to your account.

  • do not share passwords, authentication codes or account credentials;
  • do not permit another person to perform assessment activities through your account;
  • notify the relevant programme administrator or Govtech Africa promptly if you suspect that your account has been compromised; and
  • ensure that information associated with your account remains accurate and up to date.

You are responsible for activities carried out through your account to the extent permitted by applicable law, except where the activity results from a security failure for which you are not responsible.

5. Permitted Use

You may use Atlas only for lawful, authorised and legitimate purposes connected with the relevant assessment programme, including registration, evidence review, scoring, validation, reconciliation, panel review, appeals, approvals, reporting and other functions made available to your role.

You must comply with all applicable laws, programme rules, confidentiality requirements, professional obligations and instructions issued by the Programme Controller.

6. Assessment Integrity and Professional Conduct

Users involved in assessment activities must act honestly, independently and in accordance with the applicable methodology. You must not manipulate, fabricate, conceal or knowingly misrepresent evidence, scores, justifications, validation outcomes, appeal records or other assessment information.

  • scores and written reasons must reflect the user's genuine assessment under the applicable methodology;
  • validators and panel members must perform their assigned review functions independently and within the authority granted to them;
  • conflicts of interest must be disclosed where required by programme rules or professional obligations; and
  • users must not improperly influence another assessor, validator, reviewer or decision-maker.

7. Evidence, Documents and Other Content

You must have the authority to upload, submit, reproduce or otherwise make available any document, evidence, image, record, statement or other content through Atlas. You must not upload material that is unlawful, malicious, misleading, defamatory, infringing, confidential without authority, or unrelated to the legitimate assessment purpose.

Personal data and sensitive personal data should be included only where necessary, lawful and authorised. Users should minimise unnecessary personal information in evidence and supporting materials.

8. Accuracy of Information

You are responsible for taking reasonable care to ensure that information you submit through Atlas is accurate, complete and not misleading. Govtech Africa provides the platform and does not independently verify every item of evidence, statement, score or record submitted by programme participants.

9. Attribution, Audit Trails and Publication

Atlas is designed to support accountability and traceability. Actions performed through the platform may be logged and attributed to the relevant user. Depending on the applicable programme methodology, authorised assessment records may identify the author of a score, validation, justification or other action.

Assessment results, supporting information or named professional contributions will be published only in accordance with the applicable programme rules, approvals and lawful instructions of the Programme Controller.

10. Assessment Results, Decisions and Appeals

Atlas is a technology and workflow platform. Unless expressly stated otherwise in the applicable programme rules, Govtech Africa does not determine institutional scores, decide appeals, endorse assessment outcomes or exercise the statutory or official functions of the Programme Controller.

An assessment result becomes official only when approved or published by the person or institution authorised to do so under the relevant programme. Users must follow the designated review and appeal process rather than attempting to alter records outside authorised workflows.

11. Prohibited Activities

You must not, directly or indirectly:

  • access or attempt to access a programme, account, record or function for which you are not authorised;
  • circumvent role-based access controls, security measures, approval workflows or technical restrictions;
  • interfere with, disrupt, overload, damage or compromise Atlas or any connected system;
  • introduce malware, malicious code or harmful material;
  • scrape, harvest, extract or systematically copy non-public information without authorisation;
  • reverse engineer, decompile or attempt to discover source code except to the extent such restriction is prohibited by law;
  • use Atlas to impersonate another person or misrepresent your authority, role or affiliation;
  • use Atlas to infringe intellectual property, privacy, confidentiality or other legal rights; or
  • use information obtained through Atlas for an unrelated or unlawful purpose.

12. Intellectual Property

Atlas, including its software, interface, design, branding, documentation, platform logic and other materials created by or for Govtech Africa, is owned by Govtech Africa or its licensors and is protected by applicable intellectual property laws.

These Terms give you a limited, non-exclusive, non-transferable and revocable right to use Atlas for authorised purposes. They do not transfer ownership of Atlas or Govtech Africa intellectual property to you.

Ownership of programme data, assessment content and materials supplied by a Programme Controller or participating institution is determined by applicable law and the relevant contractual or programme arrangements.

13. Third-Party Services and Links

Atlas may contain links to or depend on third-party services. Govtech Africa is not responsible for third-party websites or services that it does not control. Use of a third-party service may be subject to that provider's own terms and privacy practices.

14. Availability, Maintenance and Changes

We aim to maintain a reliable and secure service, but uninterrupted or error-free availability cannot be guaranteed. Atlas may be temporarily unavailable for maintenance, security updates, infrastructure issues, emergencies or circumstances beyond reasonable control.

Govtech Africa may update or modify Atlas to improve security, functionality, legal compliance or service performance. Material changes affecting a specific deployment may also be managed under the applicable client agreement.

15. Suspension or Termination of Access

Access may be suspended, restricted or terminated where reasonably necessary to protect the platform, investigate misuse, comply with law or a lawful instruction, enforce programme rules, respond to a security incident, or give effect to a decision of the Programme Controller.

Suspension or termination does not automatically remove records that must be retained for audit, accountability, legal, regulatory or programme purposes.

16. Disclaimers

Atlas is provided as a technology platform to support assessment processes. To the maximum extent permitted by law, Govtech Africa does not warrant that every user submission, evidence item, assessment judgement or programme outcome is accurate, complete or suitable for a purpose beyond the applicable assessment methodology.

Nothing on Atlas constitutes legal, financial, audit, professional or regulatory advice unless expressly identified as such by a person authorised to provide that advice.

17. Limitation of Liability

To the maximum extent permitted by applicable law and subject to any governing client agreement, Govtech Africa will not be liable for indirect, incidental, special or consequential loss arising solely from unauthorised use, user-supplied inaccuracies, third-party services, or decisions made independently by a Programme Controller or programme participant.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability arising from fraud, fraudulent misrepresentation, wilful misconduct or any other liability that applicable law requires to remain unrestricted.

18. Privacy and Data Protection

Personal data processed through Atlas is handled in accordance with the Atlas Privacy & Data Protection Notice, the Atlas Cookie & Tracking Technologies Notice and applicable data protection law. Programme-specific processing may also be governed by a privacy notice issued by the relevant Programme Controller.

19. Governing Law and Disputes

These Terms are governed by the laws of the Federal Republic of Nigeria, unless a specific written agreement governing an Atlas deployment provides otherwise. Any dispute not resolved through an applicable contractual or programme dispute process will be subject to the jurisdiction of the courts of competent jurisdiction in Nigeria.

20. Changes to These Terms

Govtech Africa may update these Terms where the platform, applicable law, security requirements or service arrangements change. The current version will display its effective or last-updated date. Where required, material changes will be communicated through an appropriate channel.
